On top of that, companies that come for campus placement - they will put a big board for you -"Only US citizens and Green Card holders apply". I have friends who spent 50-60 K on MBA degree and they are doing software development job (They were developers even before doing MBA and they wanted to get out of it). Think about their investment - 2 years of MBA tution fee ~ 60 K + 2 years of wage loss ~ 160 K. After investing 220K if someone tell you to go and get Green Card first, dude believe me that ain't gonna feel good. Someone please give me few green dots, I have lost hope for my green card....for the time being red dots are good.

I think they had understanding of RD all along. The reason I say that is anytime I contacted IO or went to InfoPass they had this information.
What was different then was that they had all applications in sets of boxes, which had random applications.
Now thinking logically, it would take them lots of efforts to sort that mess out. And the best way out is to retrogress to a point where the available number of visas will be utilized as well a degree of fairness can be achieved.
Published dates are only a general ballpark information to indicate where are for the remaining cases. Havn't they already granted visas to those filed in August/Sept '07?

So far, they have been treating date when they physically enter data in the system (date which you see online as "we received your case on...") as the Receive Date, and making all predictions, postings and claims based on that. I'm in sixth year of H1. Also have EAD for more than 2 years but not used. Also, have valid AP (approved in Dec 2009). My I140 is approved more than a year back and I485 is pending since August 2007.
I'm going to lose my job next week. So, I've sent I9 to switch from H1 to EAD.
I'm looking for new job. But couldn't find any matching job so far as per my EB3 labor (PD oct 2004). But there are lot of full time positions that matches my EB3 labor. My employer is saying that he will cancel the I140, if I go to another company using AC21. What should I do to avoid any issue with my pending I485, if my current employer withdraws/cancells approved I140. Should I not inform my current employer about the job change till I file AC21? If you carefully see the qualifying options for an emergency appointment (who stays and currently working in US can easily qualify) , we can chose the earliest available date at any of the centers like Mumbai/ New Delhi/ Kolkata/Chennai. But the catch is first of all you have to entrust someone in india to go to HDFC bank to pay the fee and get the receipt number.
Remember, the most important thing is YOU must carry that ORIGINAL PAYMENT SLIP along with all of your documents.

But my employer is not ready to provide me with copy of my approved PERM labor and 140. Just like any other employer.
So I am planning to request both of this by making FOIA request to DOL and USCIS.
I have done some ground work for that. Now here are my questions.
1) If I haven�t applied for 485 yet will USCIS/DOL release this document to me?
Or are both of this employer�s petitions?
2) I have heard that after six month of 140 approvals it become employee petition.
How much true is that?

I don't know the Nikon story on sensor cleaning, but most cameras have a "mode" for sensor cleaning, which essentially leaves the mirror up until you switch it out of that mode.
As to formatting your memory card, my principle is "whenever there is a problem with them". I don't format my cards "to prevent problems". Most problems are caused by "user errors", such as removing the card from the slot before whatever it's in is finished with it - e.g taking the card out of the camera when it's still writing, or unplugging it from the computer before it's been erased. Others may have other ideas of what's "appropriate" here. But formatting doesn't do anything particularly different from deleting the files on the card. The main difference is that the "root directory" is recreated by the formatting, so if there's antyhing wrong there, it will be "fixed up" by the formatting - but you usually know immediately if there's anything wrong there.
Finally, in about 5500 pictures that I've taken, I've lost three pictures because the card went wrong. The camera said "CF error" or some such, so it was pretty obvious that something was wrong. Formatting in the camera solved the problem, but carrying a spare card is ALWAYS a good idea.

Additionally, have you considered getting a 3 year H1B extension based on the approved 140? I am not sure whether you can do it because you no longer work for this company. So, when you got a H1B transfer (for the new company B), did they give you 3 years or 1year extension for H1B?

Point is very simple, Congress needs to heard like crazy from legal Immigrants about issues. So please on Mon during lunch call your congressman every day for next week. Send them faxes, emails etc.
So when they vote they know that what are issues for legal immigrants.
If you don't then you won't get anything. It is that simple.

(3) First paystub of current employer
You can be without getting paid in between jobs but may have to be quick. A lot of people when they decide to change jobss on EAD, take a vacation from work for a month or so, come back and work for the last paystub and then move to a new job.
Can you do multiple jobs and start ur business on EAD ? I don;'t know, maybe someone else could answer this

now this is weird... aside from the poster's main question: why does uscis want proof of *continuous employment* since the poster filed for 485? all they should care about is the future job... isnt that right? why do they want employment history?

It is not. It is very much relevant to the case as he has not added the spouse to the I485. If the person has not been continuously maintaining the non immigrant visa status, the spouse is out of status as the 485 has not been filed and is not eligible to hold H4 status.
Also, if the person has travelled on as a parolee, USCIS may be interested in that as well. You never know what the IO is getting into when they issue the RFE. Do not judge or give the OP a feeling that the RFE is irrelevant. It is, in many ways.
